- Definitions
In these Conditions of Booking, “we”, “us” and “our” are references to seenaturesfury.com and “you” and “your” are references to the person making the booking
- These terms and conditions
These terms and conditions will be incorporated into your booking when we have received full or part payment from you. We are unable to accept bookings from anyone under the age of 18.
- Assumption of Risk
The Client agrees that their participation in Storm Chasing with See Nature’s Fury is voluntary. Furthermore, the Client agrees to assume any risk associated with participating in the event, and releases See Nature’s Fury members from all claims of loss, damage or injury that may arise during the Client’s participation. The potential risks associated with the event include, but are not limited to; vehicle accidents, lightning, hail, rain, flooding, severe wind, tornadoes, insect bites, illness, accidents caused by members of the public and other similar risks. Such releases are without limitation, and include associated costs, personal injury, property damage, and any other losses or damages suffered by the Client.
The Client agrees to acquire sufficient travel, medical and liability insurance as they deem necessary to cover these risks, which should also include cancellation risks for travel to the base city that could cause the tour to be delayed.
- Total Indemnification
The Client agrees to indemnify and hold harmless See Nature’s Fury and its members from all liabilities or claims made because of participation in this activity, whether caused by the negligence of See Nature’s Fury or otherwise. The client also agrees not to pursue any form of legal recourse against See Nature’s Fury and its members.
- Booking confirmation
If you have booked online, by email or have booked by telephone, the Contract will come into effect as soon as you have booked. You may notify us that you have changed your mind within 14 days of confirmation of your booking for a refund of your deposit, or more than 30 days before the start of the tour – whichever is the sooner. In this instance we may refund your deposit and other monies paid as set out in point 8.
- Alterations to your booking
Your booking shall be in accordance with the details confirmed at the time of booking. Your booking shall be non-transferable and non-alterable within 30 days of the tour start date. You may make alterations to your booking up to 30 days before your tour start date.
- Payment
A non-refundable (unless within 14 days of booking) deposit £250.00 per person is payable at the time of booking or the full amount. If a deposit is paid, a payment plan can then be set up to suit. Payment in full is required by April 1st the year of your tour.
- Cancellation by you
Should you need to cancel your booking you must advise us by telephone and then confirm this cancellation in writing to us by email to info@seenaturesfury.com. Your cancellation will only be effective as at the date we receive your written confirmation. Our cancellation charges cover a portion of necessary equipment hire for where we are unable to obtain full or partial refunds. These include but are not limited to car and technology hire. The amount of you refund you will receive is set out below.
Period before arrival date: Cancellation charges as a % of total cost
180 days before travel Loss of Deposit
90 days before travel Deposit + 30% of Final Balance
60 days before travel Deposit + 40% of Final Balance
30 days before travel Deposit + 50% of Final Balance
If you need to cut short your trip after it has commenced, we will assist where possible in any onward travel arrangements.
- Cancellation or changes by us
In exceptional circumstances, we may have to cancel or change some aspects of your booking. If we do so, we will tell you as soon as possible prior to your start date and you may choose either:
- a) To accept the changes offered by us
- b) Receive a full refund
We do not pay compensation in circumstances where we must cancel your booking including those arising from Force Majeure. Force Majeure means circumstances beyond our control including (but not limited to) industrial disputes, natural disasters, fire, technical problems, bad weather and acts of government.
- Right to Cancel
See Nature’s Fury maintains the right to deny the Client’s participation in storm chasing activities if they deem that participation would risk loss or damage to any party.
- Transferring your booking
If for circumstances beyond your control (for example if you are unfit to travel due to illness or you are called for jury service) you are unable to go on the trip, you may transfer your booking to another person provided you notify us as soon as possible and at least 7 days before departure. Both you and the person to whom you transfer the booking will be liable to us for proper performance of this Contract.
- Circumstances beyond our control
We shall not be liable for any delay in performing any of our obligations under this Contract where the delay is due to circumstances beyond our control. Examples of circumstances beyond our control are strikes and exceptionally bad weather. However, if any of our suppliers or agents let us down, this will not be treated as being a cause beyond our control.
- Our service to you
We do all that we can to ensure you enjoy your experience. However, occasionally, problems occur and if they do or you have any concerns when staying with us, please tell us immediately and we will do our utmost to fix them.
We will not be responsible for any matter which you knew about during your stay but did not tell us about at the time.
- Adjustments and Surcharges
If circumstances beyond our control necessitate adjustments to the tour, including price increases due to increased costs (exchange rate, global issues, fuel, hotels), we will promptly notify you of these modifications. We will absorb such costs to a point, but should the exchange rate fall below $1.10 to every £1.00 30 days before the start of the first tour, a surcharge of 5% of the tour cost will need to be added. If we deem the alterations to be significantly transformative to the tour, and you are unwilling to accept them, you have the option to cancel your booking. In such cases, we will provide a refund corresponding to the amount you have paid us for the booking. Please note that we will not be held liable for any subsequent or consequential costs or claims for compensation in this scenario.
- Insurance
We require you to take out adequate comprehensive travel insurance as you would with any other trip abroad. We cannot be held responsible for costs arising from a failure to take out such insurance cover.
- Personal Well-Being
The Client hereby warrants that they are physically fit and capable of participating in storm chasing activities without undue risk. The Client certifies that there are no health-related reasons or problems which preclude their participation in this activity.
The Client hereby consents to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.
- Rules & regulations
You agree to abide by our rules and regulations in force from time to time. You agree not to smoke or to consume alcoholic beverage while travelling in our vehicles. Any serious breach of our rules and regulations or unreasonable conduct by you will entitle us to refuse a booking or exclude you from the remainder of the trip and you will be responsible for your own costs and ours.
You also agree to be punctual regarding start times in the mornings and comply to instructions from See Nature’s Fury staff. This is for your own benefit and safety as well as other guests. We cannot be held responsible for anything that arises due to ignoring these requirements.
- Fitness to travel
We accept your booking on the basis that you have told us about any disability that you suffer and any reason that could make it unwise for you to travel. If you are disabled or may be unfit to travel, you should provide full information at the time of booking. You must check that this information appears on the special section of the booking form.
- Special Requests
If you have any special requests for services not included in the booking, for instance low floor bedrooms or special diets, you must notify these to us at the time of booking. We will do our best to provide for your requirement, however, special requests cannot be guaranteed.
- Guarantee of severe weather
We cannot guarantee severe weather during your trip. Mother nature is very fickle and there are times when the weather is quiet, even during the “storm season”. We promise to do what we can to get you to some storm activity, but we cannot guarantee this will be possible every time. Road networks, distances and safety reasons are some reasons that may make it impossible for us to get you there.
- Media Release
When booking any of our tours, please be aware that you may be photographed and filmed to be used for any legitimate purpose by See Nature’s. Your decision to join the tour implies your consent for them to capture your participation in the tour. By doing so, you are granting us, and anyone associated with us, royalty-free, non-exclusive license to reproduce, edit, share, distribute, and sublicense the film’s content worldwide.
- Acknowledgment
The Client agrees that these terms and conditions shall remain in full force and effect without modification, and that participation in storm chasing activities is pursuant to the terms of this agreement.
- Changes to these terms & conditions
We reserve the right to modify these terms and conditions, and such modifications can only be initiated by us, not by any third party. Please note that we may amend or enhance these terms and conditions without prior notice. If changes become necessary, we will provide you with a revised copy of these terms, and all reservations will be subject to the updated terms.
- Law & jurisdiction
These terms and conditions agreement shall be governed by the laws of England.
